These terms govern your use of excelodevelopment.com (the "Site"), operated by Excelo Development LLC. By using the Site, you agree to these terms. If you don't agree, please don't use the Site.

Who builds our homes

All homes are built by Excelo Construction LLC, CBC1270116.

Information on the Site

The Site is for general information only. Nothing on it is an offer to sell or a binding contract. Any purchase of a home is governed solely by a written purchase agreement signed by you and us.

Prices, plans, specifications, and availability are subject to change without notice. Square footage is approximate. Renderings and photos may show upgraded or optional features not included in the base price. Some images are artist renderings or digital illustrations and may not show an actual home.

Lot availability, move-in dates, included features, and incentives are not guaranteed until stated in a signed purchase agreement. Incentives may require use of specific lenders or title companies and may change or end at any time.

Pricing tools and payment estimates

Our home configurator, pricing tools, and any monthly payment estimates are for illustration only. They are not a quote, a loan offer, or a commitment to lend. Final pricing depends on the lot, plan, selections, and site conditions, and is set only in a signed purchase agreement. Loan approval, rates, and payments are determined by your lender.

Price lock

A price lock holds the all-in price shown for your selected plan and upgrades for 30 days from the date shown on your confirmation. The all-in price covers permits, impact fees, survey, engineering, and site work for a standard lot. It does not include the purchase of a lot. If your lot needs more, such as additional fill, heavy tree removal, or utility assessments, we list those items and their prices in your Lot Report before you sign. A price lock is free, doesn't obligate you to buy, and is not a purchase agreement. The final price is set in a signed purchase agreement.

Text messaging program

By providing your mobile number and agreeing to our consent terms, you consent to receive calls and text messages from Excelo Development at that number, including marketing calls and texts about your inquiry, tours, and available homes, which may be sent using automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help, or contact us at (239) 555-0100. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

Intellectual property

The Site's content, including floor plans, photos, renderings, text, logos, and software, belongs to Excelo or its licensors and is protected by copyright and other laws. You may view it for personal use. You may not copy, reproduce, or build from our floor plans or designs, or reuse other content commercially, without our written permission.

Acceptable use

Don't use the Site to break the law, submit false information, interfere with the Site's operation, or scrape or collect data from it by automated means.

Third-party links

The Site may link to sites we don't control. We aren't responsible for their content or practices.

Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties about the Site, including accuracy, availability, and fitness for a particular purpose. This does not affect any warranty provided in writing with the purchase of a home.

Limitation of liability

To the fullest extent allowed by law, Excelo is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content.

Governing law

These terms are governed by the laws of the State of Florida. Any dispute about the Site will be resolved in the state or federal courts located in Lee County, Florida.

Changes

We may update these terms at any time. Continued use of the Site after changes means you accept them.
